있다.271) 즉, 에너지 효율, 신기술 및 혁신, 해양 교육 및 훈련, 해상보안, 해양교통관리 및 해상인프라 개발을 위한 국제 표준 개발 및 구현을 통해 친환경적이고 지속 가능한 글로벌 해상운송시스템에 필요한 제도적 기본틀을 제공하는 역할을 담당한다.272)
IMO(국제해사기구, 이하 IMO로 약칭)는 국가가 아니므로 국제조약을 채택할 권한은 없으나 관련 사안에 대해 외교적 회의를 통해 영향력 있는 의견을 개진할 수 있다. IMO 는 해양안전과 보안, 해양오염의 방지(환경보호), 책임과 보상, 기타의 4개의 위원회를 두고 있으며, 위원회는 각각 사무국을 둔다.
2. 국제협약
IMO는 다양한 해사 관련 주제에 있어 60개 이상의 협약 관련 업무를 담당하고 있으며 (다음 표 5-1참조),273) 새로운 조약을 위한 협상과 채택업무에 있어 중요한 역할을 담당한 다. IMO가 간여하는 조약은 주로 크게 2가지로 나누어 볼 수 있는데, 하나는 해양안전 (maritime safety)와 다른 하나는 해양환경보전에 관한 것이다. 다만 IMO에서는 관할 협약 들을 내부 조직구도에 따라, ① 해양안전과 보안, ② 해양오염의 방지(환경보호), ③ 책임 과 보상, ④ 기타로 나누고 있다.274) 하나의 사건을 놓고 볼 때, 사실관계는 하나라도, 관련되는 각 부문에 속하는 협약들과 연관되어지며 그에 따라 각각의 위원회와 부서에서 각 해당 문제별로 다루어진다.275)

-(1) 우리나라 가입 협약
1) UN해양법협약
UN해양법협약인 UNCLOS 는 수백년 간 논란이 되어 온 국제적 바다의 이용에 관한 관할권을 보다 명확히 하였다. UNCLOS 는 해양생물자원과 관련하여 영해, 배타적 경 제수역, 대륙붕, 공해의 4가지 대표수역에서 대해 규정하고 있다.285)
UNCLOS 는 다양한 해양 관련 국제 규범을 통합하여, 항해권, 영해의 한계, 경제수 역, 좁은 해협에서의 항해, 해양환경의 보전․관리․보호, 연구체계, 국가 간 분쟁에 대한 법적구속력이 있는 합의 절차 등 해양과 관계된 광범위한 사안에 대하여 규정하고 있다.
UNCLOS 는 해양을 위한 헌법으로도 불리운다.
2) 바다에서의 인명안전에 관한 협약
이 중에서도 바다에서의 인명안전에 관한 협약 은 모든 종류의 선박의 내항성286)에 관한 광범위한 사안을 다루고 있다. 이 협약은 기국들로 하여금 자국 선적 선박들이 건조, 설비, 운영 등에 있어 최저한도의 안전기준을 준수하도록 하고 있으며, 전 세계 상선들의 안전에 관한 가장 중요한 국제협약이라고 할 수 있다.287) 해상인명안전협약은(SOLAS 1974) 74년 11월 1일 채택, 1980년 5월 25일 발효되었으며, 우리나라에서는 1980년 12년 31일 비준, 1981년 3월 31일부터 발효되었다.
1960년 IMO의 최초의 법들 중 하나로 제정되어 1974년 개정되면서 오늘날과 같이 해상 에서의 선박의 안전을 규제하게 되었다. 그 부속서는 선박건조, 화재안전장비, 인명구조설 비, 라디오커뮤니케이션, 항행의 안전, 유해화학물질을 포함하여, 화물적선, 선박의 안전한 운영, 해양안보를 향상시키기 위한 조치 등에 관한 기준을 규정하고 있다.

이 법의 기준은 국제항해용 500톤 이상의 선박과 크기를 불문하고 여객선에 대하여 의무적으로 적용되어 진다. SOLAS가 정하는 요건을 갖추지 못한 선박에 대하여는 국제 항구에 정박이 거부될 수 있다.
① 안전(인명구조)장비
SOLAS는 선박의 안전을 위한 화재시 감지 및 소화장비와 인명구조를 위한 장비를 갖 출 것을 요구하고 있다.288) 또한 선박의 종류에 따라 갖추어야 할 구조선, 구명보트, 구명 조끼에 대하여도 규정한다.289)
② 통신설비
SOLAS는 국제항해용 여객선 및 화물선에 대하여 국제해난구조체계(Global Maritime Distress Safety System: GMDSS))과 연결될 수 있는 통신(라디오)장비를 갖출 것을 규정 하고 있다. 통신장비는 비상위치 발신장치(Emergency Position Indicating Radio Beacons:
EPIRBs)와 탐색구조용트랜스폰더(Search and Rescue Transponders: SARTs)를 포함하여 야 한다.290) 이 법의 기준은 국제항해용 300톤 이상의 선박과 여객선에 적용된다.
③ 화물적선
SOLAS는 화물적재에 대한 요건과 대량 액체와 가스를 제외한 화물의 종류와 화물컨 데이너의 안전확보요건에 대하여 규정하고 있다.291) 또한 선체 길이 150미터가 넘는 대 량화물선에 대한 구조상의 기준요건에 대하여도 규정하고 있다.292)
④ 국제항구 등 안보
SOLAS는 선박의 보안을 유지함에 있어서의 선장의 역할이 선사, 용선주, 다른 어느 누구로부터 제한되어서는 안된다고 하고 있다.293) 또한 항구시설이 보안 평가를 수행하

고 항구시설 보안계획을 개발, 실행, 검토할 것과, 항구에서의 선박의 지연, 구류, 제한 또는 추방에 대해 관리할 것을 요구한다.294) 선박은 다른 안전 수단 외에 선박보안 경보 시스템을 갖추어야 한다고 하고 있다.295)
3) 선박으로부터의 해상오염방지를 위한 협약
선박으로부터의 해상오염방지를 위한 협약 은 당초 유류, 독성액체물질, 포장물질, 폐 수와 폐기물에 의한 오염에 관한 기술기준을 부속서에 포함하고 있었다. 그 후, 1997년 선박으로부터의 대기오염에 관한 추가 부속서를 채택하였고, 최근 선박의 방오시스템의 사용에 관한 협약 ,296) 국제 항행에서의 평형수의 사용에 관한 협약 297)을 채택하였다.
