제 13 장 신용장통일규칙(UCP 600) 주요 조항
ㅇ The Uniform Customs and Practice for Documentary Credits, 2007 Revision, ICC Publication no. 600 (“UCP”) are rules that apply to any documentary credit (“credit”) (including, to the extent to which they may be applicable, any standby letter of credit) when the text of the credit expressly indicates that it is subject to these rules.(제1조)
(제6차 개정 신용장통일규칙(2007년 개정, 국제상업회의소 간행물 제600호, "신용장통일규칙")은 신용장의 문면에 위 규칙이 적용된다는 것을 분명하게 표시 한 경우 모든 화환신용장{위 규칙 이 적용 가능한 범위 내에서는 보증신용장(standby letter of credit)을 포함한다. 이하 "신용장"
이라 한다}에 적용된다.)
ㅇ Credit means any arrangement, however named or described, that is irrevocable and thereby constitutes a definite undertaking of the issuing bank to honour a complying presentation.(제2조) 그 명칭과 상관없이 개설은행이 일치하는 제시에 대하여 결제(honour)하겠다는 확약으로서 취 소가 불가능한 모든 약정을 의미(신용장(Credit)은 한다.)
ㅇ Honour means:
a. to pay at sight if the credit is available by sight payment.
b. to incur a deferred payment undertaking and pay at maturity if the credit is available by deferred payment.
c. to accept a bill of exchange (“draft”) drawn by the beneficiary and pay at maturity if the
credit is available by acceptance. (제2조) (결제(honour)는 다음과 같은 내용을 의미한다.
a. 신용장이 일람지급을 약정하였다면 일람출급으로 지급하는 것.
b. 신용장이 연지급을 약정하였다면 연지급의 확약을 부담하고 만기에 지급하는 것.
c. 신용장이 인수를 약정하였다면 수익자가 발행한 환어음을 인수하고 만기에 지급하는 것.)
ㅇ Negotiation means the purchase by the nominated bank of drafts (drawn on a bank other than the nominated bank) and/or documents under a complying presentation, by advancing or agreeing to advance funds to the beneficiary on or before the banking day on which reimbursement is due to the nominated bank. (제2조)
(매입(Negotiation)은 일치하는 제시에 대하여 지정은행이, 지정은행에 대한 상환의무 있는 은 행영업일 또는 그 이전에 대금을 지급함으로써 또는 대금지급에 동의함으로써 환어음(지정은행 이 아닌 은행 앞으로 발행된) 및/또는 서류를 매수(purchase)하는 것을 의미한다.)
ㅇ A credit is irrevocable even if there is no indication to that effect. (제3조) (신용장은 취소불능이라는 표시가 없더라도 취소가 불가능하다.)
ㅇ A nominated bank acting on its nomination, a confirming bank, if any, and the issuing bank must examine a presentation to determine, on the basis of the documents alone, whether or not the documents appear on their face to constitute a complying presentation. (제14조) (지정에 따라 행동하는 지정은행, 확인은행이 있는 경우의 확인은행 그리고 개설은행은 서류에 대하여 문면상 일치하는 제시가 있는지 여부를 단지 서류만에 의해서 심사하여야 한다.)
ㅇ A nominated bank acting on its nomination, a confirming bank, if any, and the issuing bank shall each have a maximum of five banking days following the day of presentation to determine if a presentation is complying. This period is not curtailed or otherwise affected by the occurrence on or after the date of presentation of any expiry date or last day for presentation. (제14조)
(지정에 따라 행동하는 지정은행, 확인은행이 있는 경우의 확인은행 그리고 개설은행에게는 제 시가 일치하는지 여부를 결정하기 위하여 제시일의 다음날로부터 기산하여 최장 5 은행영업일 이 각자 주어진다. 이 기간은 유효기일 내의 제시일자나 최종제시일 또는 그 이후에 발생하는 사건에 의해서 단축되거나 달리 영향을 받지 않는다.)
ㅇ A presentation including one or more original transport documents subject to articles 19, 20, 21, 22, 23, 24 or 25 must be made by or on behalf of the beneficiary not later than 21 calendar days after the date of shipment as described in these rules, but in any event not later than the expiry date of the credit. (제14조)

본이 포함된 제시는, 이 규칙에서 정하고 있는 선적일 후 21일보다 늦지 않게 수익자에 의하거 나 또는 그를 대신하여 이루어져야 하고, 어떠한 경우라도 신용장의 유효기일보다 늦게 이루어 져서는 안 된다.)
ㅇ In documents other than the commercial invoice, the description of the goods, services or performance, if stated, may be in general terms not conflicting with their description in the credit.
(상업송장 이외의 서류에서, 물품, 서비스 또는 의무이행의 명세는, 만약 기재되는 경우, 신용장 상의 명세와 저촉되지 않는 일반적인 용어로 기재될 수 있다.)
