Subject : MARPOL 73/78의 최근 개정에 따른 증서발급 관련 알림

1. MARPOL ANNEX Ⅱ (NLS, IBC, BCH)

Res.MEPC.118(52), Res.MEPC.119(52)에 따른 MARPOL Annex Ⅱ 및 IBC Code의 전면개 정이 2007년 1월 1일 발효됩니다.

이와관련으로 우리선급은 기술정보(2006002/IMO) 및 세미나를 통하여 신 P&A Manual과 Cargo Operation Manual의 승인 및 신증서를 발급받도록 공지한 바 있으나 현재까지 승인 신청이 미미한 상황입니다. 개정 발효일에 임박하여 일시에 신청될 경우 부득이 승인에 장 시간이 소요될 수 있으니, 가능한 한 충분한 시간 여유를 갖고 관련 매뉴얼 승인 및 신증서 발급받기 바랍니다.

2. MARPOL ANNEX Ⅳ (ISPP)

MARPOL Annex Ⅳ가 2003년 9월 27일 발효되었으며, 적용 기준을 완화한 Res.MEPC.115(51)이 2005년 8월 1일 발효되었습니다. 이와관련으로 국제항해하는 G/T 400톤 이상 선박 및 16인 이상 승선이 보증된 G/T 400톤 미만의 선박은 ISPP증서를 발급받아야 합니다.

- 신선 : 부속서의 발효일(2003. 9. 27) 이후에 건조계약이 체결된 또는 건조계약이 없는 우에는 용골이 거치되거나 이와 동등한 건조단계에 있는 것; 또는

부속서의 발효일로부터 3년 이후에 인도되는 것.

- 현존선 : 신선 이외의 선박으로써, 협약 발효 5년이 되는 시점까지(2008. 9. 27) ISPP 증서를 발급받아야 함.

3. MARPOL ANNEX (IAPP)

MARPOL Annex Ⅵ가 2005년 5월 19일 발효되었으며, IAPP검사 종류에 연차검사를 추가한 Res.MEPC.132(53)이 2006년 11월 22일 발효될 예정입니다.

따라서, 2006년 11월 22일 이후 연차일이 도래하는 경우 차기 연차검사일을 새로이 지정하였으니 최신 Survey Status를 확인하여 IAPP 연차검사를 수검하여야 합니다.

4. Anti-Fouling System Convention (IAFS)

- AFS 협약은 아직 발효되지 아니 하였으나 협약의 조기이행을 위하여,

.1 2003년 1월 1일부터 생물파괴제(Biocides)로 작용하는 유기주석화합물이 포함된 방오시스템의 사 용을 금지하며,

.2 2008년 1월 1일부터 생물파괴제(Biocides)로 작용하는 유기주석화합물이 포함된 방오시스템이 선

Korean Register of Shipping Page 2/2 체 외부 또는 표면에 남아 있지 않게 하거나(sand-blasting과 같은 방법으로 완전제거), 이전의 유기주석화합물이 포함된 방오시스템이 용해되어 흘러나오지 않도록 밀봉도장(sealer coating)을 하여야 함.

- AFS 협약 발효 이후, 국제항해하는 당사국의 모든 선박은 국제방오시스템증서(적용 : G/T 400톤 이상의 선박 등) 또는 선주가 자체적으로 방오시스템선언서(적용 : 길이 24 m 이상이지만 총톤수 400톤 미만 등)를 선박에 소지하여야 합니다.

참고로, AFS 협약의 ‘총톤수’는 1969 ITC 협약에 따른 총톤수를 전적으로 적용하며, 국내 톤수를 적용하지 않습니다.

그러나, 동 협약이 발효되지 않은 관계로 우리선급은 선주의 요청시 국제방오시스템 적합확인서 (IAFS-SOC)를 발급하고 있습니다.

특기 사항으로써, 길이 24 m 이상이고 총톤수 400톤 미만인 국제항해 선박의 경우, 선주나 선주의 대리인에 의하여 서명된 방오시스템선언서를 자체적으로 비치하여야 하고 그러한 선언서는 적절한 서류(페인트 영수증 또는 계약자 인보이스)를 수반하거나 적합한 이서를 포함하여야 합니다. (끝)

1. MARPOL Annex Ⅱ (NLS, IBC, BCH)

The total amendment of MARPOL Annex Ⅱ and IBC Code in accordance with Res.MEPC.118(52) and Res.MEPC.119(52) will enter into force on 1st January 2007.

In this regard, it is required that the issuance of the new certificate including the approval of the new P & A manual and the new Cargo Operational manual.

The approval service of the a.m. manuals is somewhat time-consuming. So, if too many applications are piled up in near the end of this year, approval for the new manuals may be delayed.

Accordingly, it is advised that the corresponding shipowners should submit the application on this matter as soon as possible. (The approval service of the manuals : Machinery Team)

For your reference, the newly classified products since the adoption of the amended IBC Code in 2004 have been circulated by BLG./Circ. 19.

2. MARPOL Annex Ⅳ (ISPP)

MARPOL Annex Ⅳ entered into force on 27th September 2003 and Res.MEPC.115(51) which alleviates the requirements of the application entered into force on 1st August 2005, also.

According to the a.m. amendments to the Annex Ⅳ, ships engaged in international voyage of 400 gross tonnage and above, and less than 400 gross tonnage which are certified to carry more than 15 persons should retain ISPP Certificate.

- "New ship" means a ship :

for which the building contract is placed, or in the absence of a building contract the keel of which is laid, or which is at a similar stage of construction, on or after the date of entry into force of this Annex ;or

the delivery of which is three years or more after the date of entry into force of this Annex.

- "Existing ship" means a ship which is not a new ship.

In particular, all existing ships should retain ISPP Certificate until five years, namely 27th September 2008, from the date of entry into force of this Annex.

3. MARPOL Annex Ⅵ (IAPP)

MARPOL Annex Ⅵ entered into force on 19th May 2005, and Res.MEPC.132(53) which adds the Annual survey to the Annex Ⅵ will enter into force on 22nd November 2006.

Accordingly, in case the anniversary date of the already issued IAPP Certificate comes from 22nd November 2006, the due date for the annual survey was newly designated. In this regard, it is advised that the corresponding shipowners should check the recent Survey Status and then arrange the coming annual survey for the

Korean Register of Shipping Page 2/2 periodical endorsement of the IAPP Certificate.

4. Anti-Fouling System Convention (IAFS)

- The International Convention on the Control of Harmful Anti-Fouling Systems on ships, which was adopted on 5 October 2001, prohibits the use of harmful organotins in anti-fouling paints used on ships and establishs a mechanism to prevent the potential future use of other harmful substances in anti-fouling systems.

In the case of the reference to a requirement being effective on 1 January 2003, if the convention comes into force at a later date, then the legal effect is moved forward to that date. In other words, the legal effect of the 1 January 2003 date is suspended until the entry into force date.

Under the terms of the convention, by 1 January 2008 (effective date), ships either:

(a) shall not bear such compounds on their hulls or external parts or surfaces; or (b) shall bear a coating that forms a barrier to such compounds leaching from

the underlying non-compliant anti-fouling systems.

- After this Convention enters into force, ships of 400 gross tonnage and above which are engaged in international voyages are required to be hold the International Anti-Fouling System Certificate. While, ships of 24 meters or more in length, but less than 400 gross tonnage engaged in international voyages shall carry a Declaration signed by the owner or owner authorized agent.

For your reference, Gross Tonnage in accordance with 1969 ITC is wholly applied in the Convention for Anti-Fouling System. National Tonnage is not applicable.

However, Because this Convention is not yet entered into force, this Classification Society issues, at the request of owners, the Statement of Compliance for the International Anti-Fouling System Certificate (hereinafter called Certificate) after successful completion of a survey.

In particular, a ship of 24 meters or more in length, but less than 400 gross tonnage engaged in international voyages should carry a Declaration singed by the owner or owner authorized agent. Such Declaration shall be accompanied by appropriate documentation (such as a paint receipt or a contractor invoice) or contain appropriate endorsement. - The End -
