Ⅰ. Open for Proposal

(Design Proposal Competition)

1. The Aim of the Design Proposal Competition

This competition is conducted in accordance with Articles 4 and 29 of the MOLIT (Ministry of Land, Infrastructure and Transport) that is under notice No. 2014-345 for the Operation Guidelines for Architectural Design Proposal Competition. By opening for Design Proposals, this competition aims to select the appropriate design(er) for 「Korean Cultural Center」 in Sweden, which aims to open next year in Stockholm, Sweden.

Please find <NOTE 1> and <NOTE 2> below.

2. Overview of the Design Proposal Competition

A. Scope of the Task : Design Proposal for 「Korean Cultural Center」

✓ Design Proposal will be a drawing of site plan (plot plan) which can facilitate Korean culture experience and education.

✓ Design Proposal must cover exhibition hall, library, cooking studio, dance studio, cultural lecture rooms, reception, meeting rooms, office area, storage and etc.

B. Ordering Organization: The Embassy of the Republic of Korea in Sweden, Section of Culture & Public Relations

C. Proposal Competition Period: 2021.12.2 – 2021.12.22

D. Design Period: 2,5 months from the commencement date (January to March 2022)

**Renovation will be carried out between April to July 2022

< NOTE 1: Korean Cultural Center >

1. Legal status

○ “Korean Cultural Center” is an affiliated facility of a diplomatic mission established by the Minister for Foreign Affairs of the Republic of Korea to promote international cultural exchange and Korean culture.

2. Key functions

○ Promotion of cultural exchange between Korea-Sweden, introduction and promotion of Korean culture

▲ Holding exhibitions, performances and film screenings for the cultural exchange between Korea-Sweden

▲ Programs and lectures to introduce and experience Korean culture

- Korean language, food, traditional music, arts and crafts, calligraphy, Taekwondo, K-Pop

▲ Operating comprehensive information center related to Korean culture and tourism (Books, DVDs, digital data, etc.)

▲ Support for cooperation and network activities in the arts, sports, tourism and academic fields of Korea and Sweden

- Supporting for participation from Korea in international cultural activities such as festivals, fairs and book fairs in Sweden

- Holding workshops and seminars for cultural, educational and academic cooperation

3. KCC across the world

○ Korea has been operating 32 Korean Cultural Centers in 27 countries around the world.

- There is a total of 10 Korean Cultural Centers in Europe. The Cultural Center in Stockholm, Sweden will be the first one in Northern Europe.

○ The total number of operating personnel in the Korean Cultural Center around the world is an average of 9 which are composed of 1 Director (diplomat status) and 8 administrative staffs.

▲ Different user groups

- Public opinion leaders such as major government figures and the media, group visits (schools, associations and gatherings, companies, etc.), Swedish general public (individuals, families, couples, etc.), Korean adoptees, overseas Koreans, Korean institutions in Sweden, students (middle

& high school, college), local residents and local cultural and artistic institutions, residents outside of Stockholm (mobile cultural center, online events, etc.)

▲ Perform various functions to properly promote Korea including one-off events - Promotion and marketing of Korean culture

- Inquiry and research on demand on Korean culture and national image of Korea in Sweden - Discovering and fostering pro-Korea groups in Sweden

- Promotion of cultural exchange between Korea-Sweden and strengthening of the network ▲ Operating the KCC tailored to the characteristics and needs of the Swedish people

- Running “sustainable”, “mid- to long-term”, “seasonal” programs rather than small-scale and one-off events

- Running programs that take into account the behavioral patterns of Swedish people such as the climate, vacation culture of Sweden, etc.

- In addition to K-POP, an introduction to various Korean culture formed from the long history and traditions of Korea

- Securing a space where the KCC identity is expressed (full or partial

* The exterior will traditional Swedish architectural design and it must be designed as a space where the visitors can feel Korea as soon as they step inside (Little Korea in Sweden).

* Arranging a multi-purpose space which can be separated from/merged, and examining the possibility of creating spaces such as a library, cafeteria, kitchen, small classrooms, etc.

4. Required Qualification of the Applicant

○ Under any of the following qualifications, the applicant (a company) who can successfully perform the given task;

- The applicant (a company) who holds Architect License issued by the Architects Act (Building Act) of the host country (Sweden or EU) and that has officially registered or reported the opening of an architectural office.

- The applicant (a company) who has more than 5 years of experience in spatial·interior design with the relevant degree or qualification, who has officially registered or reported its interior design business. In this case, the applicant (a company) should jointly participate with another party who holds Architect License issued by the Architects Act (Building Act) of the host country (Sweden or EU).

Ⅱ. Selection Process of Design Proposal Competition

1. Registration

All participants must register for the competition in advance with the required documents below submitted via e-mail, otherwise deemed disqualified:

① Application for Participation (Form 1)

② Documents proving the eligibility for the competition (e.g., license, etc.)

③ Joint Supply and Demand Agreement (when required only, Form 2)

2. Inquiry

All inquiries related to Design Proposal Competition should be filled out in ‘Design Competition Written Inquiry’ (Form 3) and sent to jhh21@mofa.or.kr . This means other inquiry methods such as call are unavailable. Reply aims to answer all questions submitted and it can have the same effect and validity as the given invitation. Also, any irrelevant inquiries cannot be answered.

3. Acceptance of Design Proposals

A. Submit your proposals with the following documents (※see <NOTE 4> below):

① Design Competition Proposal Submission Form (Form 4)

② Experience and Performance of the Design in Charge (Form 5)

**in case of join supply and demand, only the representative side will submit.

③ 1 copy of Design Proposal (one copy for filing, three copies for evaluating)

B. All submitted proposals (via visit, e-mail, or mail) must arrive before 2021.12.16 at 17:00, otherwise will be considered invalid. The late submission caused by any unwanted delays cannot be excused.

C. You must receive a confirmation letter (Design competition proposal receipt) after applying your proposal.

4. Evaluation

A. Evaluation Process

o Examiner: The Embassy will evaluate the submitted proposal and presentation with the following examiners: a total of five experts related to architecture and design, and others.

o Examination schedule: 2021.12.17 (Fri.) o Venue: Online

* Please note that the evaluation process above can be changed and if any occurs, the applicant will be contacted immediately.

B. Evaluation

o Evaluation committee is composed of about 4 people including experts related to architecture and design.

o Evaluation is made by examining both the submitted proposal and presentation. Also, in principle, the evaluation is based on the voting system by examiners.

o Applicants will not be required to prepare a separate presentation material, but to use the submitted material.

o The date and the order of your presentation will be individually notified to the selected applicants

o Presentations and Q&A session should be with 30 mins lengths, and the duration time may be adjusted by the evaluation committee.

* The above schedule is subject to change depending on the circumstances of the ordering organization, and any change will be individually notified immediately.

C. Evaluation Criteria

○ In principle, the evaluation is based on the voting system, and may be changed to the marking system at the request of examiners.

○ When conducting evaluation with the voting system as a principle, the table of the Evaluation Criteria below will become additional reference materials. When changing to the scoring system, the members of the evaluation committee will give points according to the Evaluation Criteria below.

D. Disqualification

: The Applicant will be disqualified if he/she

○ wrote false information in the documents submitted,

○ did any misconducts that affect the evaluation result before and after the evaluation process,

○ or if all examiners unanimously determine the applicant’s disqualification.

5. Selection Result

A. The selection result will be notified to the successful applicant individually and also be announced on the official website of the KR Embassy on 2021.12.17

B. The successful applicant has a right to sign a Design Service Contract for 「Korean Cultural Center」in Sweden and also must follow the protocol that the Korean Embassy provides. (Design fee: 300 000 SEK Incl. all taxes and reimbursable expenses)

C. After the selection, the details and guidelines of the design service are subject to a separate contract and “task instruction”.

D. Any matters concerning the copyright of the successful applicant’s design proposal will be in accordance with the provisions of the Korean Copyright Act.

E. Please note that if there is no suitable designer as a result of the proposals’ evaluation process, nobody may be selected.

Ⅲ. Contents and Considerations

1. Objectives

A. Space planning to properly embody the purpose and usage of the “Korean Cultural Center”

B. Planning considering the behavioral patterns of Swedish people, the status of cultural needs and weather conditions

C. Space planning for the convenience of multiple visits, use and assembly

D. Proposal must be suggested to the extent of 6 000 000 SEK, the budget of Renovation Fee (Incl. VAT and reimbursable expenses):

2. Detailed Contents and Considerations When Writing the Proposal

A. Suggestion of zoning plan and movement line in accordance with the function and operation strategy of the KCC (※ Please refer to <NOTE 5> below)

○ Plan for merging and dividing the use of space to maximize space utilization.

* Consider that exhibitions, performances, film screenings, reading clubs, handicraft workshops, Korean food cooking classes may be held simultaneously or with a slight time difference depending on the design of the operation program.

○ Suggestions of an appropriate movement line of visitors, which they can stay longer.

○ Measures to minimize limitations and problems of the existing facilities

* Steel stairway in the middle of the building, large pillars on each floor, no halls dedicated to stage performances, utilization of underground space such as sauna

○ Planning for future expansion

* Considering the possibility of expanding the library due to the expansion of collection, the office space due to the increase in staff and the warehouse due to the increase of equipment

B. Proposal of a design specialization plan unique to the “Korean Cultural Center in Sweden”

○ Suggestions of how to reveal the identity as a KCC

* A way to simultaneously introduce Korea’s long history and tradition as well as the latest advanced IT technology

○ Proposal of a space focused on specialized contents (*Books, Korean foods, Movies, Handcrafts and Design) for “Korean Cultural Center in Sweden”

C. Measures to improve accessibility for the disabled and the elderly and openness to visitors

○ Convenience such as toilets for the handicapped and elderly, entrance and exit, floor accessibility, stroller parking, etc.

○ Providing a sense of “Korean hospitality” in the entrance, reception and overall design

○ Establishing a solution to recognize the internal program from the outside

○ Raising the identification and awareness of the building as “Korean Cultural Center in Swede” from the outside

< NOTE 6: Detailed Task Scope for Design Service >

• The successful applicant of the design proposal comeptition has priority to conclude a design service contract within the scope described below with the ordering organization.

• The design fee for this project is 300 000 SEK (Incl. all taxes and reimbursable expenses), and the project period is until completion.

• The ordering organization (the Embassy of the Republic of Korea in Sweden) will select a contractor based on the designer’s design through an open call for construction.

The task will include and be limited to:

Phase 1. Design Studies/Tenant Information Package 1.1. Concept Design

o Objectives

Based on the program brief and the preliminary space plans developed by KCC, develop the project space plans and project design concept, ensuring the appropriate balance between the expression of KCC’s image and the satisfaction of the functional and technical requirements in line with KCC

o Activities

✓ Review of the base building documentation for analysis

✓ Review of the base building documentation for analysis

✓ Review KCC’s programming requirements, design guidelines and identify upgrade requirements for the base building

✓ Develop the conceptual space use diagrams, individual spaces, team areas, special use zones for the project

✓ Generate design ideas and options for the volumes, materials, colors for the “public”

areas

✓ Research into materials availability and suitability

✓ Coordinate with all base building consultants including those designated by KCC, i.e., audiovisual, security, LAB, etc.

✓ Analyze the existing furniture inventory and investigate furniture options (for additional furniture)

✓ Organize and animate the design presentations leading to a shared vision of the project’s design concepts and aspirations

✓ Concept design plan layouts, showing size and relationships of individual work areas, team zones, visitors’ areas, support spaces

✓ Sketches, drawings, 3D vignettes required to communicate the design concept to the project team

✓ Outline scope of works (architectural trades)

✓ Outline project schedule (provided by the Project Manager)

1.2. Design Development/TI Package o Objectives

Develop the approved deliverables from the programming and conceptual design phase into detailed design, remaining true to the previously established design objectives, integrating the technical aspects, while respecting the budget and schedule constraints

o Activities

✓ Organize and animate the design presentations leading to a shared vision of the project’s design concepts and aspirations

✓ Preparation of proposed finishes materials, colors and furniture selection

✓ Development of the detailed set of plans and typical details for the project

✓ Identify critical areas for samples/mock-ups

✓ Leadership of the design process: management of design schedule, sign-offs, integration and coordination of the technical design, including those nominated designers/consultants such as furniture, audiovisual

✓ Meet with Building Code Consultant to ensure compliance with local Code regulations

✓ Provide input into the preliminary estimate (provided by Cost consultant) and participate in the estimate review

✓ Develop schematic scope of works

During Phase 1, the selected applicant and the other parties who are participating jointly must ensure collaboration and cooperation with both KCC’s project team as well as the base building design team. Regular project review meetings and workshops must be held during Phase 1:

✓ Weekly project meetings held in Stockholm or by conference call

✓ Bi-weekly project reporting meetings in Stockholm or by conference call

✓ Regular project workshops with the base building architect and consultants team on issues of technical integration and coordination and base building design review

Phase 2. Consultancy Service during Fit Out Tender

The successful applicant must provide consultancy services during the tender process as per KCC’s request.

Joint Supply and Demand Agreement

Article 1 (Object) In this agreement, the members of the joint supply and demand enter into a contract according to a certain investment ratio for planning, bidding and execution of construction, goods or services by mobilizing finance, management and technical capability, personnel and equipment.

Article 3 (Members of the Bidding Consortium) (1) Members of the bidding consortium are as follows.

Article 4 (Valid Period) This agreement shall enter into force upon the signing of the parties and shall be terminated upon the completion of the performance in the agreement.

However, the effect of this agreement shall remain as long as rights and obligations related to the construction remain with the respect to the ordering organization or a third party.

Article 5 (Obligations) The bidding consortium shall utilize all necessary knowledge and skills based on sincerity, diligence and good faith in order to carry out the object stipulated in Article 1.

Article 6 (Responsibilities) The members of the bidding consortium shall be jointly and severally responsible for the performance of service obligations to the ordering organization. However, a company that does not meet the contract performance requirements as a company for which a performance guarantee has been submitted is liable according to the investment ratio.

Article 7 (Subcontract) If some of the members of the bidding consortium wish to conclude a subcontract independently, they must obtain the consent of the other members.

Article 8 (Transaction Account) The advance payment and the interim payment as stipulated in Article 11 of the “Joint Contract Management Guidelines” shall be paid to the following accounts.

Article 9 (Investment Ratio of Members)

(1) The investment ratio of each bidding consortium shall be determined as follows.

(2) The ratio in Paragraph 1 may be changed in any of the following cases; However, the entire investment ratio of some members of the bidding consortium cannot be transferred to other members if the investment ratio is changed.

1. In case the contract amount is increased or decreased due to changes in the contract details with the ordering organization

2. In case a member of the bid consortium has difficulty in fulfilling the contract according to the contents of the agreement due to bankruptcy, dissolution, receivership, workout (a company that is undergoing restructuring as the creditors decided to be subject to restructuring according to the Corporate Restructuring Promotion Act) or mid-term withdrawal, and a request to change the investment ratio is made through the joint signature of the members of the bid consortium

(3) Investments other than cash shall be evaluated by the members in consideration of the market value

Article 10 (Distribution of Profit and Loss) If a profit or loss occurs after the fulfillment of the contract, it shall be distributed or shared according to the ratio specified in Article 9.

Article 10.2 (Cost Sharing)

(1) Each member shall share the subcontract cost, material cost, labor cost and expenses incurred for the fulfillment of this contract according to the investment ratio.

(2) The members of the bidding consortium may separately determine the time and method of the payment to be shared by each member through mutual agreement.

(3) If a member of the bidding consortium fails to pay the expenses pursuant to Paragraph 1, the interim payment corresponding the unpaid amount calculated in consideration of the investment ratio shall be stored in the account under the joint name of the bidding consortium, and it will be paid to the member when the payment is completed.

(4) If a member fails to pay the contribution 3 or more times, the remaining members may withdraw from the member with the consent of the ordering organization.

However, the number of non-payments that can cause the withdrawal can be set differently with the consent of the ordering organization depending on the payment period, etc.

Article 11 (Restrictions on Transfer of Rights and Obligations) Members cannot transfer their rights and obligations under this Agreement to a third party.

Article 12 (Measures against Mid-term Withdrawal)

(1) A member of the bidding consortium may not withdraw until the date of completion of the bidding and execution of the contract except in cases falling under any of the following subparagraphs. However, in the case of subparagraph 3, other members must take measures to withdraw.

1. If the ordering organization and all the members agree

2. In case of non-performance of the contract without bankruptcy, dissolution or other justifiable reasons, or if the members of the bidding consortium agree to withdraw the member who fails to make the payment according to Article 10.2

In case of receiving restrictions on the qualification to participate in the bidding pursuant according to Article 76.1.6 of the Enforcement Decree for failing to perform the relevant contract without bankruptcy, dissolution or other justifiable reasons among the members of the bidding consortium

(2) In the event that some of the members have withdrawn pursuant according to Paragraph 1, the remaining members shall perform the relevant contract jointly.

However, if the remaining members do not meet the requirements necessary for the fulfillment of the contract such as license, performance, construction capability disclosure amount, etc., they must make it possible to meet the requirements by adding new members, etc. after obtaining approval from the ordering organization.

(3) In cases of the main sentence of Paragraph 2, the investment ratio shall be added to the ratio in Article 9 by dividing the investment ratio of the withdrawing member out of the investment ratio of the remaining members.

(4) After the contract is fulfilled, the remaining amount shall be returned to the withdrawn member after deducting the loss in Article 10.

Article 13 (Warranty Liability) The bidding consortium shall be jointly and severally liable in the event of a defect in the service after the bidding consortium is disbanded.

However, a company that does not meet the contract performance requirements as a company for which a performance guarantee has been submitted is liable in accordance with the investment ratio.

Article 14 (Operating Committee)

(1) The bidding consortium shall establish an operating committee with members of the bidding consortium as its members to discuss all matters related to the implementation of the contract.

(2) Matters not stipulated in this Agreement shall be determined by the operating committee.

A joint Supply and Demand Agreement is concluded as above, and x copies of the Agreement are prepared as evidence. The members of the bidding consortium shall sign and seal each copy and keep them individually.
