Article 23 (Preparation of Books and Drawings) (1) The overall control officer or a management officer shall keep any of the following books accompanied by a drawing expressing any City-owned property falling under his/her jurisdiction and any other documentary evidence of rights relationship relevant to such City-owned property, record the status of management and movement thereof, and keep such record:

1. Overall control books of managed property:

2. Administrative property books;

3. Preservation property books; and 4. Miscellaneous property books.

(2) Each of the property books provided in paragraph (1) of this Article shall separately prepared and managed according to classification of property such as land, buildings, structures, standing trees and bamboos,

and vessels as provided by the attached Form Ⅴ: Provided, That if affairs related to the management of property are computerized and fed into a computer, the property books may not be kept and may be substituted by such feed, and in this case, in order to preserve and manage the contents fed into the computer, those contents shall, in turn, be fed into a diskette, which shall be kept. <Proviso Newly Inserted by Rule No. 2350, Aug. 20, 2001>

(3) The price to be entered in the public property-related books shall be a purchase price in case of purchased property, an exchange price in case of exchanged property, the amount of recompense in case of expropriated property, and the amount provided in any of the following subparagraphs in case of any other property respectively:

1. In case of land, the amount which is evaluated taking into account the current price of any other land similar thereto;

2. In case of a standing tree or bamboo, the amount which is calculated by multiplying its unit cost put according to its current price by its volume: Provided, That in case of a garden tree or any other standing tree or bamboo which is difficult to calculate on the basis of its volume, the price to be entered in the public property-related books shall be the amount which is evaluated taking into account its current price;

3. In case of a building or any other structure, the amount which is evaluated taking into account its construction expenses or current price, and in case of a vessel or any other movable property, the amount which is evaluated taking into account its manufacturing expenses or current price; and

4. In case of a right accruing from any investment in stocks, a debenture bond, a local bond, or a beneficiary certificate issued by an investment trust company or development trust company, the paid-up amount, the amount of investment or the nominal value.

Article 24 (Adjustment of Books and Notification) (1) If there is any increase, decrease or variation in City-owned property, the Director of Accounting shall, without delay, adjust the relevant books, correct the relevant drawings, and notify a competent management officer thereof.

(2) If a management officer receives any notification under paragraph (1), he/she shall, without delay, adjust the relevant books and the relevant drawings.

Article 25 (Report on Increase, Decrease or Movement) (1) If there is any increase, decrease or variation in City-owned property, a competent management officer shall adjust the relevant books and make a report thereon to the overall control officer not later than the following tenth of every month, accompanied by a report on increase, decrease or variation of City-owned property prepared in accordance with the attached Form Ⅵ and any other documentary evidence of rights relationship relevant thereto.

(2) A management officer shall totalize the status of increase or decrease of City-owned property under paragraph (1) as of the end of every year and make a report thereon to the Mayor.

(3) A management officer shall reevaluate any City-owned property falling under his/her jurisdiction under Article 81 of the Decree and submit a report thereon prepared in accordance with the attached Form Ⅶ

to the Mayor.

Article 26 (City-owned Property Leased or Permitted to Other Persons) If any City-owned property is leased or permitted to other persons, the overall control officer and a competent management officer shall keep and adjust such books of property leased or permitted to other persons as are prepared in accordance with the attached Form Ⅷ.

Article 27 (Permission for Use of Administrative Property) The use of administrative property provided in Article 12 of the Ordinance shall be permitted in accordance with the attached Form Ⅸ and the attached Form

Ⅹ.

Article 28 (Lease Agreement) A lease agreement provided in Article 30 of the Ordinance shall be as shown in the attached Form Ⅺ.

Article 29 (Plan for Management of Public Property, etc.) The form of a plan for the management of public property provided in Article 39 of the Ordinance, an agreement on the sale of public property, etc. shall be as follows:

1. A plan for the management of public property (attached Form ⅩⅢ);

2. A plan for the sale of public property (attached Form ⅩⅥ);

3. An agreement on the transfer of public property (attached Form ⅩⅦ);

4. A requisition of the purchase of public property (attached Form ⅩⅧ);

and

5. An agreement on the exchange of public property (attached Form ⅩⅨ) Article 30 (Permission for Lease or Use) (1) If a management officer

intends to lease or permit any City-owned property falling under his/her jurisdiction to other persons, he/she shall examine the following matters

after receiving an application prepared in accordance with the attached Form ⅩⅩⅠ from the applicant and deal therewith in consultation with the overall control officer in advance: <Amended by Rule No. 2274, Oct.

11, 1999>

1. Indication of the said City-owned property;

2. Report on the calculation of rent on the said City-owned property;

3. Deleted; <by Rule No. 2274, Oct. 11, 1999>

4. Domicile and full name of the said applicant;

5. Purpose of the use of the said City-owned property;

6. Period of time for such lease or permission; and 7. Drawing expressing the said City-owned property.

(2) The provisions of paragraph (1) shall also apply in case of continued lease.

(3) If a management officer has leased or permitted any City-owned property falling under his/her jurisdiction to other persons under paragraph (1), he/she shall make a report thereon to the overall control officer. <Newly Inserted by Rule No. 2274, Oct. 11, 1999>

Article 31 (Adjustment Books of Lease and Use) The overall control officer and a management officer shall keep and adjust the adjustment books of the lease and use of City-owned property prepared in accordance with the attached Form ⅩⅩⅡ.

Article 32 (Report on Evaluation of Price) The report on the evaluation of price provided in Article 24 (3) of the Ordinance shall be as shown in the attached Form ⅩⅩⅢ.

Article 32-2 (Hearing on Indemnities, etc.) If an advance notice of

indemnities is sent under Article 28-2 (1) of the Ordinance, it shall be determined by the attached Form ⅩⅩⅢ-2 (1), and an opinion on advance notice of indemnities provided in paragraph (2) of the said Article shall be as shown in the attached Form ⅩⅩⅢ-2 (2).
