Toward a New System of Land Management and Administration

Background and Purpose

Land administration has changed in accordance with socio-economic development and environment. The demand for land management has increased in all aspects of society these days but it is already beyond the capacity of the ministry of land management. Current administrative procedure and paperworks in land management have hampered the efficient land management system in Korea.

Although Korean government has made an effort to relax land regulations since the end of 1980's, it has not reached the full expectation of the public. Land management system should be in harmony with its operation in order to function properly.

Land management should be reformed to eliminate any inconvenience caused by excessive paperworks and therefore achieve its maximum efficiency for the benefit of the public.

This research aims to provide the solution for simplifying the administrative procedures for the benefit of the public and improve the efficiency in land management. This research also emphasizes that functional structure in land management should be modified and workload should be shared with local autonomous organizations to improve the land management system in Korea.

Major Areas of Analysis

This report consists of six chapters. The first chapter focuses on the current problems of land management and research objectives and methods.

The second chapter explains the basic theory in land management.

The third chapter focuses on relevant laws and regulations in land management.

In this chapter, current situations of administrative procedures on land management, organization, how to secure viability(ex: negligence fine, penalty, imprisonment) as of violations are analyzed in depth. Especially, the administrative procedures on land management are categorized into land ownership, transaction, information, all relevant taxes and management of national property.

The forth chapter summarizes problems in the land management and its operations. It is also noted that unnecessary and inefficient procedures should be eliminated. As for filling out a number of documents relevant to various land administration, redundant items should be removed and supplementary items added. This chapter deals with the feasibility on distribution of rights between central and local governments in relation with characteristics of rights which belong to their own tasks or authorization. It also deals with various organizations responsible for land administration in provinces, cities, and counties. It's property is examined by investigating of fines, penalty imprisonment in the each law, With regard to the land management and administration.

The fifth chapter suggests policy alternatives with emphasis on the improvement in organizational structure and workload sharing as well as increase in the efficiency in administrative procedure of land management.

The sixth chapter concludes the discussion on policy alternatives and makes a proposal to the government.

Policy Suggestions

First, administrative procedures in land management should be simplified and changed for the benefit of the public. overlapped paperworks should be simplified. The requirement for attaching the additional documents can be relaxed. One stop administrative procedures should be adopted to improve efficiency in land management. Land management network should be built up as soon as possible and it should be widely used in land management.

Second, functional structure in land management should be modified and workload should be shared with local autonomous organizations to maximize

efficiency in land management system in Korea. Rather than delegating a full authority to the local autonomous organizations, government should share administrative workload with these organizations. Special functional body for land management should be established within the local autonomous organizations.

Third, systematic restructuring in land management should take place to increase the efficiency in administrative works and violation of regulations in land management should be penalized accordingly. Imposing a restriction or limitation on administrative activities is a main way to regulate land management.

Authority to grant permission is used to relax any regulations in land management. In order to effectively enforce the regulation, it is necessary to punish the those who violate it.
