캄보디아에서의 외국인 근로자 점검 강화에 대한 부처 합동 포고문

부총리 겸 내무부장관 노동직업훈련부장관

1. 내무부와 노동직업훈련부의 합동포고 719는 캄보디아내의 기업, 기관, 카지노, 유흥업소와 기업활동 또는 투자를 위해 입국한 외국인에 대한 외국인 근로자 점검에 대한 법적 규정을 제공한다.

2. 이민청, 노동국장이 발행한 증명서를 소지한 합동점검반(Foreign Labor Inspection Group)만이 사전 통보 또는 통보 없이 외국인 인력 검사 업무의 임무를 갖는다.

3. 외국인 근로자 합동점검반이 검사를 수행할 때, 캄보디아내의 기업, 기관, 카 지노, 유흥업소와 사업활동 또는 투자를 위해 입국한 외국인들은 다음의 필요 한 서류를 제시하고 합동점검반에 협력하여야 한다.

◦ 법인설립증서(Articales of Incorporation of the company/enterprise, 원본 1부)

◦ 상무부발행 등록증서(Certificate of Registration issued by Ministry of Commerce) 또는 동등한 서류 1부.

◦ 직원명단(Staff Decleration¹⁾, 원본 1부)

◦ 신입자·퇴직자 명단(‘In and Out’ Staff Decleration²⁾, 원본 1부)

◦ 직원쿼타 증서(Quota Certification³⁾, 원본 1부)

◦ 근로계약서(Employment Contract, 노동부 날인 크메르어 원본) 각 직원 1부

◦ 직원별 여권(원본, 사본 2부)과 사진(4x6cm, 2장)

◦ 직원별 입국비자, 취업연장비자(E비자) 원본 및 사본 1부

◦ 직원별 노동허가(Work Permit), 고용카드(Employment Card) 원본과 사본 1부

◦ 노동법, 이민법 책자 각 1부

4. 캄보디아에서 활동하는 기업, 소기업, 행상, 야간업소 등 모든 영리활동을 하 는 외국인은 노동허가와 취업카드 발급 절차를 준수하기 위하여 해당 기관이 발행하는 사업허가를 받아야 한다.

5. 외국인 근로자를 채용한 사업주, 기관, 유흥클럽, 카지노, 투자자, 개인사업자 등은 캄보디아의 노동법과 이민법을 준수하여야 하여야 하며, 노동허가와 취 업카드가 없는 외국인은 캄보디아에서 근로에 종사할 수 없다.

6. 노동허가와 취업카드가 없는 외국인 근로자와 이들을 채용한 법인 또는 기관, 개인사업자는 노동법 제16장과 이민법 제5장 및 제6장에 따라 벌금과 벌칙을 받게 된다.

7. 이민청과 노동국은 사업주, 기관, 유흥클럽, 카지노, 투자자, 개인사업자 등이 불법 외국인 노동자를 사용하고 있다고 판단될 경우 시 또는 주 법원에 외국 인 인력의 검사를 요구할 수 있다.

8. 이민청과 노동국은 시 또는 주 법원에 야간업소의 외국인 인력 조사를 요구 할 수 있다.

9. 국경에 거주하며 오전에 캄보디아에 입국하여 임시적 노동행위를 하고 오후 에 돌아가는 외국인 인력도 노동허가와 취업카드를 취득해야 한다.

10. 캄보디아 노동법과 이민법을 준수하는 법인과 기업체들은 내무부와 노동부로 부터 감사장을 받게 된다.

11. 위 합동포고(PRAKAS)에 반하는 외국인 근로자에 대한 점검 강화에 대한 포 고 #2703(2016.3.10.) 또는 다른 포고나 결정문 등은 폐기한다.

12. 경찰청, 내무부와 노동부, 수도 및 지방 행정부는 이 합동 포고문(PRAKAS) 을 서명일부터 적용해야 한다.

Decision

Article 1: Inter-Ministerial Prakas No.719, jointly from the Ministry of Interior (MOI) and Ministry of Labour and Vocational Training (MLVT), provides the legal provisions and regulations for foreign labor inspections for owners and directors of enterprises, institutions, casinos and entertainment clubs, and foreigners who come to invest or operate business activities in the Kingdom of Cambodia.

Article 2: Only Foreign Labor Inspection Group has the duty to conduct foreign manpower inspections by using a joint assignment letter issued by the General Department of Immigration and the General Department of Labour, with prior notice or without prior notice.

Article 3: When the Foreign Labor Inspection Joint Group conducts an inspection, owners or directors of enterprises, institutions, casinos and entertainment clubs, and foreigners who come to invest or operate in any business activities in the Kingdom of Cambodia, shall cooperate with the Foreign Labor Inspection Joint Group and show the following necessary documents:

1. Articles of Incorporation of the company / enterprise (Original) 1 copy.

2. Certificate of Registration issued by Ministry of Commerce or equivalent document 1 copy.

3. Staff Declaration (Original) 1 copy.

4. Staff Declaration “In and Out” (Original) All copies.

5. Quota Certification (Original) 1 copy.

6. The employment contract of foreigners in Khmer language, (stamped) by the MLVT or the Department of Labor and Vocational Training (Original) All foreigners.

7. Foreigner’s passports (Original & Copy) and (Photos 4x6) 2 copies for all foreigners.

8. Entry visa and visa extension authorized for employment of the foreigner (Original & Photocopy) All foreigners.

9. Foreigner’s work permit and employment card (Original & Photocopy) All foreigners.

10. Books of Labor Law and Law on Immigration 1 copy.

Article 4: Any Foreigners who operate small business, sub-businesses, unnamed business, mobile business, night time business, floating business or operate other business activities must obtain a business permit issued by the competent authorities in order to comply with the formalities for issuance of work permits and employment cards.

Article 5: When accepting foreigners for employment, owners or directors of enterprises, institutions, casinos and entertainment clubs, and foreigners who come to invest in businesses shall properly abide by the Law on Immigration and the Labor Law of the Kingdom of Cambodia. Foreigners cannot operate any business in the Kingdom of Cambodia without a work permit and employment card issued by the Ministry of Labor and Vocational Training.

Article 6: Any owners or directors of enterprises who employed foreign workers or foreign workers who work or operate a business without a work permit and employment card, shall be subject to fines and penalties in accordance with Chapter 16 of the Labor Law and the provisions of Chapter 5 and chapter 6 of the Law of Immigration of expulsion.

Article 7: The General Department of Immigration, the General Department of Labor request a representative from the municipal or provincial court to inspect the foreign manpower at the enterprises, institutions, casinos and entertainment clubs in case any suspected of using illegal foreign labor.

Article 8: The General Department of Immigration, the General Department of Labor request a representative from the municipal or provincial court to inspect the foreign manpower at the night businesses.

Article 9: Foreign manpower who live at the border who enter Cambodia in order to operate any business activities in the morning and go back in the evening or temporary stay must complete the immigration form according to the law of the Kingdom of Cambodia or implement according to the MOU with the Kingdom of Cambodia must obtain work permit or employment card.

Article 10: Any owner or directors of enterprises and institutions who properly abide by the Law on immigration and Labor Law, shall receive a letter of commendation from the MOI and MLVT.

Article 11: Joint PRAKAS #2703

object to the above joint PRAKAS is abrogated.

Article 12: Secretary General, Chief Cabinet, General Commissariat of National Police, Director General, Director General Department and chief of related units under the guidance of the Ministry of Interior and Ministry of Labor and Vocational Training, Capital / Province administration must implement this joint PRAKAS effect from the date of signature.
