Project operator should make the protocol of land and goods after the completion

of survey on land and property(Article 7.2 of the Enforcement Decree of Land Compensation Act). After filling out the form of land protocol and goods, the sign or seal of landowner and relevant people should be obtained. (1)If landowner and relevant people refuse to give signature or sign without any reasonable cause or (2) if obtaining signature or seal is not possible as landowner and relevant people cannot be identified or there is no information on the address or location where they live, the reason for it should be written in the protocol of land and list of on-the-ground goods.

2. If land is divided due to the public works, the lot number before division should be filled in

"lot number(initial lot number)" field.

3. In the "relevant people" field, the people who has the right to the land excluding ownership should be written.

5. In case of road site, the characteristics of the road including type, current use and location should be written in "remarks"field along with other information.

Preparation for Compensation

1. Announcement and Reading of Compensation Plan

Announcement of compensation plan is to inform the preparation of compensation to the landowner. Major items related to the date of compensation announcement are as follows. Therefore, holding of compensation council and confirmation of appraiser recommended by landowner should be completed in advance to prevent civil claim related to short period of notice. If there many goods omitted in the process of adjudication, the consultation may be regarded as insincere consultation delaying adjudication. Therefore, the reading of land protocol and goods by owner should be done sufficiently to prevent objection by landowner due to omitted property.

Article 44.4 of Enforcement Decree of Land Compensation Act : Governor of special province, mayor or head of county or province or project operator should install compensation council within 30 days after the expiration of reading period of compensation plan and the installation of the consultation should be notified. The compensation council should be established within 44 days after the date of compensation plan announcement(reading period is 14 days and within 30 days after the expiration of reading period).

Article 28 of Enforcement Decree of Land Compensation Act : If landowner

wants to recommend appraiser, he should notify his intention to recommend appraiser to project operator within 30 days after the expiration of reading period.

Article 44.3 of Enforcement Rule of Land Compensation Act : Those who obtained fishing rights after the date of compensation plan announcement(under this article, it means the notification of compensation plan to landowner and relevant people) or the date of project approval announcement under Article 22(hereinafter referred to as "project approval date, etc.") are not subject to compensation for fishery.
