DECREE of the Public Health Office of the Slovak Republic, which imposes measures in the event of a threat to public health on restriction of mass

events

The Public Health Office of the Slovak Republic (hereinafter referred to as the “Office”) pursuant to § 5 par. 4 letter k) of Act no. 355/2007 Coll. on the protection, support and development of public health and on the amendment of certain laws as amended (hereinafter referred to as the “Act”) due to the COVID-19 pandemic, issues this decree pursuant to Section 59b of the Act, which it orders, pursuant to Section 48 para. 4 letter d), e), r), s), w), y), z) and aa) of the Act, the following measures in the event of a threat to public health:

§ 1

(1) For the purposes of this Decree, the following shall be considered to be a person vaccinated with or who overcome the COVID-19 disease (hereinafter referred to as the “OP regime”):

a) a fully vaccinated person,

b) a person who has overcame COVID-19 in a period not exceeding 180 days ago.

(2) For the purposes of this Decree, the following shall be considered a fully vaccinated person:

a) a person at least 14 days after the administration of the second dose of the COVID-19 vaccine with a two-dose schedule, but not more than one year after the last dose, or

b) a person at least 21 days after the first dose of a COVID-19 vaccine with a single-dose schedule, but not more than one year after the last dose, or

c) a person at least 14 days after the first dose of the COVID-19 vaccine, if the first dose of the COVID-19 vaccine has been administered within 180 days of overcoming the COVID19 disease, but not more than one year after the last dose, or

d) person up to 12 years and two months of age.

(3) A person who has overcome COVID-19 in a period not more than 180 days ago means a person who can prove the stated fact on the basis of a positive result of the RT-PCR test; in children under 12 years of age also on the basis of a certificate from a general practitioner for children and adolescents issued on the basis of a positive antigen test carried out at a mobile vaccination center issued by 15 November 2021.

(4) If this Decree stipulates the obligation to prove with a certificate of vaccination against COVID-19, a certificate of negative test for COVID-19 or a certificate of overcoming COVID-19, that certificate may be replaced by an EU digital COVID pass if it is issued; otherwise, these facts must be proved by a document from which the identity of the proving person can be determined.

§ 2

General provisions for mass events

(1) Unless this decree provides otherwise, all natural persons, natural persons - entrepreneurs and legal entities are prohibited from organizing mass events.

(2) Prohibition according to par. 1 does not apply to the following types of collective events:

a) mass events in connection with the performance of work, while all participants will be in the OP regime at the time of the beginning of the mass event; the maximum capacity of such a mass event is 10 people,

b) church services, ecclesiastical or civilian versions of wedding, funeral and baptism ceremonies according to § 4,

c) meetings, sessions of public authorities and their advisory bodies, d) meetings, sessions and other events held on the basis of law, e) elections,

f) performance of mass events necessary with the course of the following professional competitions in selected sports:

1. ice hockey: TIPOS extraliga (hockey - men), ICE HOCKEY LEAGUE (hockey - men), Slovak Hockey League (hockey - men),

2. football: FORTUNA Liga (football - men), II. football league (football - men), 3. handball: NIKÉ Handball Extraliga (handball - men), MOL Liga (handball -

women),

4. volleyball: Extraliga men (volleyball), Extraliga women (volleyball),

5. basketball: NIKÉ Slovak Basketball League (men - basketball), NIKÉ Extraliga women (basketball - women),

6. international competitions organized by an international sports federation on the basis of clubs' participation in competitions according to points 1 to 5.

g) mass events necessary for the operation of quarantine training centers for top sports approved by the Ministry of Health of the Slovak Republic and the Ministry of Education, Science, Research and Sport of the Slovak Republic issued after November 24, 2021.

§ 3

General arrangements for holding mass events

The following measures are established for the performance of mass events both indoors and outdoors:

a) in the case of mass events organized outdoors, the organizer is obliged to earmark the space of the mass event and mark its entry and exit.

b) to ensure at the entrance to the premises of the mass event according to § 2 par. 2 letter a) notification of the fact that the organizer allows entry to the mass event only to persons in the OP regime,

c) allow entrance to the premises of the mass event according to § 2 par. 2 letter (a) only participants in the regime under b),

d) allow entry and stay at the place of the mass event only with properly covered upper airways,

e) the organizer is obliged to keep the telephone or e-mail contact of the visitors for a period of two weeks from the end of the event for the purposes of the epidemiological inquiry; after the specified period, the organizer is obliged to destroy the data,

f) perform frequent disinfection of areas, especially contact surfaces, handles, interior floors and objects,

g) sanitary facilities must be equipped with liquid soap and paper towels,

h) provide dispensers for alcoholic hand disinfection at the entrance to the building and ensure disinfection of hands, or ensure another adequate method of hand disinfection,

i) provide notification at the entrance to the building that in the event of an acute respiratory illness, the person is obliged to remain in home isolation,

j) publish a notice in a visible place with the information:

1. if a person shows signs of acute respiratory illness, it is necessary to contact your doctor by phone and leave the place of the mass event,

2. no handshakes,

k) when attending a public mass event and when arriving and leaving the mass event premises, to ensure that the spacing of 2 m between persons is observed; this does not apply to

i. persons living in the same household, ii. partners,

iii. persons performing sports activities, iv. artists performing artistic activities,

v. training persons towards trained persons,

vi. other persons, if it follows from the purpose of the mass event that this separation between the persons involved cannot be observed, vii. if all persons participating in the mass event are in OP regime.

l) ensure adequate ventilation of the premises,

m) the organizer must be able to prove at all times the number of persons currently participating in the mass event.

§ 4

Arrangements for the performance of worship services, ecclesiastical or civilian versions of the wedding ceremony, funeral ceremony and the baptismal ceremony

For the performance of church services, church or civil services versions of the wedding ceremony, funeral ceremony and the baptismal ceremony, the following measures apply:

a) disinfect used objects used for the purpose of the ceremony,

b) in case of contact of the priest with the mouth of the believer, the priest must always disinfect his hands; when receiving Communion under both kinds always use a new spoon with each recipient,

c) the use of drinking ceremonies from one container by more than one person is prohibited,

d) in premises where ceremonies are performed, water containers are removed, e) the maximum capacity of the mass event of church and civil versions of the

wedding ceremony or baptism ceremony is 6 people,

f) the organizer of the worship services is obliged to comply with the maximum capacity of 1 person per 25 m2 of space or 30 people.

§ 5

Arrangements for the holding of meetings or sessions of public authorities and their advisory bodies, other events held on the basis of law and elections

For the performance of mass events according to § 2 par. 3 letter c) to e) the measures according to § 3 letter d), f) to m) apply equally.

§ 6

Measures for the performance of mass events of a sporting nature

Collective events according to § 2 paragraph 3 letter (f) must comply with the following conditions:

a) spectator participation in a mass event is prohibited,

b) testing of players and members of the implementation team of clubs or teams participating in competitions according to § 2 par. 3 letter f) by RT-PCR test for the presence of coronavirus SARS-CoV-2 (nasal swab and nasopharynx) or by antigen test will be provided by the clubs before each round (not more than 48 hours before the meeting), but no more than once every 7 days,

c) testing according to point b) does not apply to persons with immune status according to § 1 par. 1,

d) ensure a sufficient number of organizers to monitor compliance with preventive measures

e) measures according to § 3 letter (a), (d) to (l) shall apply mutatis mutandis.

§ 7

Ordering more stringent measures by regional public health authorities

Regional public health authorities may, according to § 48 par. 7 of the Act within its territorial district, due to the epidemiological situation, order stricter measures.

§ 8

Repealing provisions

The Decree of the Public Health Office of the Slovak Republic no. 261/2021 V. v. SR, which imposes measures in the event of a threat to public health to limit mass events, is repealed.

§ 9 Efficiency This Decree shall enter into force on 10 December 2021.
