Safety and Legal Problems Related to the Popularization of Drones

Drones were developed for military purposes at first, but they have increasingly been used in the public sphere for such purposes as managing disasters, searching for missing people, obtaining weather and environmental information, and solving crimes. Furthermore, they are being used in the commercial sphere for all sorts of uses like drone parcel service, drone-journalism, and individual leisure. However, drones pose risks even though they, as a new technology, bring positive changes. For examples, they can cause people to trip and fall, they can cause collisions due to machine errors, they could possibility be used for terror or crime, and they can allow for invasion of privacy. Of course, it is impossible to remove all of these risks, but it is necessary to make a legal system to control them.

I think that the Korean Aviation Act should be reconsidered. The definition of drone and drones’ legal status are not clarified, and the regulation system works according to only drones’ weight. Also, frequency reapportionment should be considered to prevent physical accident, required equipment installation to prevent collision and falling down, and a mandatory insurance system to pay for damage caused by drones. It is also necessary to establish a registration system to control drones and their pilots to prevent drones from being used in terrorism and crimes. Moreover, it is necessary to discuss and review the constitutional issue related to drone technology, that is, privacy rights. In legislative theory, legislative complementation should be considered through reorganizing the current Aviation Act such that provisions related to drone technology, which are scattered in the Act, should be put together in a new chapter. Provisions should be added regulating the
